A California jury has ruled that Bill Cosby was responsible for the drugging and sexual assault of a woman in 1972, awarding her a total of $59.25 million in damages. The verdict was reached after a lengthy trial in Santa Monica that lasted nearly two weeks.

The jury determined that Cosby, who is now 88 years old, was liable for the sexual battery and assault of Donna Motsinger. They granted her $17.5 million for past damages along with $1.75 million for anticipated future damages, encompassing mental distress and other suffering caused by the incident.

Punitive Damages and Reactions

In a subsequent phase of the trial, jurors awarded an additional $40 million in punitive damages aimed at holding Cosby accountable for his actions. Cosby’s legal representative, Jennifer Bonjean, expressed disappointment with the verdict and announced intentions to appeal.

This ruling comes almost five years after Cosby’s release from prison in Pennsylvania, where a previous criminal conviction related to similar charges was overturned. Although he has settled and faced other lawsuits, this latest award marks the largest sum he has been ordered to pay in a case.

In her statement, Motsinger expressed that the verdict represented more than just her personal story—it was about having her voice validated and making sure that Cosby faced consequences for his actions. “I have carried the weight of what happened to me for more than 50 years. It never goes away. Today, a jury saw the truth and held him accountable,” she stated. She hopes this outcome empowers other survivors still seeking to share their stories.

Motsinger, who used to serve at a restaurant in Sausalito, recounted in her 2023 lawsuit how Cosby invited her to a comedy show, where he allegedly provided her with wine and pills that left her with hazy memories of the night. According to her account, she regained consciousness only to realize she had been assaulted, waking up disoriented and partially undressed.

Defending Cosby, his attorneys claimed that Motsinger’s accusations lacked factual basis, emphasizing that she admitted uncertainty about what truly transpired. However, the court proceedings moved swiftly, reaching a resolution in just two and a half years, much quicker than many of the other lawsuits against Cosby.

Attorney Jesse Creed, representing Motsinger, praised the jury’s commitment to reviewing the evidence presented and applauded Motsinger’s bravery in coming forward. During the trial, Cosby did not take the stand, although witnesses included others who had previously accused him.

This case continues to resonate within the larger context of sexual assault allegations against Cosby, which span over 60 women making similar claims, all of which Cosby has denied. As the former icon once celebrated as “America’s Dad” has faced unprecedented challenges, this verdict signifies a critical moment in the ongoing discourse surrounding accountability and the #MeToo movement.
